...A decade ago, former Long Beach Polytechnic high school football star Brian Banks was convicted of kidnapping and raping a classmate, but this morning his conviction was dismissed after his accuser recanted her story. .

Banks, who was 17 at the time of his trial, pleaded no contest to the charges in order to avoid the possibility of facing 40 years to life in prison in a conviction. He spent six years in prison and was under very restrictive parole (GPS tracking,little in the way of employment) until his accuser was recorded saying she wasn't raped and that she is afraid of coming forward because she might have to return the $1.5 million her family won from the Long Beach Unified School District in a civil suit.

basically, she recanted ( she wanted to let bygones be bygones) before a private investigator( not the law) but it was enough for brian to get an attorney from the california innocence project (they had never taken a claim from someone who served time and was done, but were just as outraged as i was hearing this) and have the L.A. D.A. overtune the conviction with little trouble.

by his own admission, he pleaded "no contest" on the advise of his attorney to get a lesser sentence

" as of now' the DA has no intention of pressing the matter furthur, and instituting charges against the accuser!!!!

this man in his interviews sounded so magnanimous (spelling?) i honestly can say that i wept, i understand he is due some compensation, but can't sue because it wasn't a false imprisonment as per his plead but can get up to $100/day of his detention i believe i heard.

but to think that my tax dollars went toward incarcerating him and keeping him on constant surveillance and registering him as a sex offender and now i am paying for his well deserved restitution and the false accuser has nothing to worry about "at this time" ??? i think this deservers a big WTF, bold capitals and all

i think she is due for a good azz kicking, and the line starts behind me, but i'm going to need at least half an hour

What gets me is that if found guilty the sentence is usually about 18 months for perverting the course of justice, Its been said that they should get the same sentence the falsely accused would have served for rape on average in the UK 8 years.

'Every false allegation of rape increases the plight of those women who have been victims of this dreadful crime.
'It makes the offence harder to prove and, rightly concerned to avoid the conviction of an innocent man, a jury may find itself unable to be sufficiently sure to return a guilty verdict.'
He said it was an offence which not only causes great problems for the victim, but also damages the administration of justice in general in 'this extremely sensitive area'.

As a separate line of enquiry, police traced DNA samples which led them to Mr Boarer, who was arrested at his workplace in front of a large number of colleagues.
He was questioned and held in a police cell before being released on bail.
It was only later that the police discovered an online exchange between the suspect and Sowden and realised that she had been lying.

How many years would he have got if found guilty? Apply that to her as well as making her sign the sex offenders register. But judges should keep the names of the innocent parties under wraps.

How can she be jailed for only 14 months. If the innocent man had been foun d guilty he would of got years. If you claim a false crime has happened you should get the same punishment the innocent person would of got if found wrongly guilty


14 months? Not good enough! False accusers should be jailed for the maximum term the real charge carries. If he could have got ten years, then she should get ten years.


14 months is not a fair sentence she should of got the same sentence that inacent guy would oif got if he would have been found guilty lets campain to get the law changed so if you accuse an inacent person of rape etc you serve at least 10 years with no parole thats the only way this sort of thing will stop woman are geting away with it far to much and its the inacent that suffer


False rape is IMHO every bit as bad as the actual thing. Stupid cow should have got 10 years for that!
 
Mr. Banks is currently hitting the summer camps, so far the seahawks, chargers, and redskins are on his agenda. given the recent
stories regarding the saints and junior seau and the escalating player safety/head concussion issues the nfl could use a real feel good story. I think this one would do nicely. Of course along with this there are other concerns regarding his ability and safety.if he isn't up to snuff I would hope that a potential employer wouldn't dress him just for publicity but it certainly wouldn't be a bad thing to groom him for a front office position
